Historical regulatory analysis prepared October 15, 2026. This original account examines FDA’s September 10, 2026 codification and July 19, 2023 Galen decision, with FDA database and eCFR observations dated October 6, 2026. It does not report a new authorization or establish present authorization, availability or patient benefit. ENT Daily Dispatch’s original factual paraphrase of the cited U.S. Food and Drug Administration records, including the official Federal Register order distributed by GovInfo. No government endorsement is implied; no source images, seals or logos are reproduced.
FDA's September 10 final order places the classification for a cooperative powered surgical-assist device for ENT surgery into the Code of Federal Regulations as 21 CFR 874.4460. The order takes effect on its publication date, but its underlying Class II decision dates to July 19, 2023. The September notice codifies that earlier decision.
The agency names Galen Robotics as the requester for the Galen ES Robotic Surgical Assistant Platform. FDA's De Novo database lists the platform under DEN220047 and product code QXG, with a July 22, 2022 received date and a July 19, 2023 granted decision. The database was marked last updated October 5 when read on October 6; that page-update date is not a new authorization date.
The device class describes assistance with instrument placement and stable positioning while the surgeon retains direct physical control. The consolidated eCFR section available on October 6 displayed Title 21 as current through October 2 and reproduced the Class II special controls. Its definition does not describe an autonomous system performing an operation.
The product-specific letter is more precise about the permitted use. It describes assisting the movement and holding of specified Integra Jako Micro Laryngeal Alligator Forceps during rigid microlaryngeal procedures. Use is specified for an experienced, trained otolaryngologist in an operating room with patients 18 or older. Those historical indications should not be expanded to arbitrary instruments, pediatric care or all ENT procedures.
The September order's risk table identifies injury to anatomic structures, delayed device removal and infection. Its controls require simulated-use testing with an anatomically relevant model, instrument compatibility, usability assessment and emergency removal after power loss or device failure. Further requirements address hardware and software verification, electromagnetic compatibility, electrical and thermal safety, sterility, shelf life and biocompatibility. These are testing requirements, not measured improvements in patient outcomes.
Required labeling covers compatible instruments, training needed before use, relevant performance-testing summaries and reprocessing instructions for reusable components. A labeling requirement does not establish that a particular hospital has completed training or adopted the platform.
The authorization route and the device-class pathway are distinct. The July 2023 letter granted the Galen De Novo request and said the device as described in that request could be marketed immediately, subject to applicable general and special controls. The September 2026 order states that the device type is not exempt from premarket notification; the FDA QXG classification record observed on October 6, 2026 listed 510(k) as its submission type. That class listing does not turn Galen's historical De Novo grant into a new 510(k) clearance.
For an ENT team following surgical-assist technology, the useful distinction is between the device-class requirements, the product-specific indication and clinical performance. These reviewed records establish the dated classification and authorization history. They do not establish current commercial availability, price, hospital adoption or comparative patient outcomes. The separate FDA decision-summary document was not reviewed, and no claim about its clinical evidence is made.
For ENT teams following surgical-assist technology, a device-class rule and a product-specific decision answer different questions. Reading their dates, indications and testing requirements separately helps keep a 2026 codification from being mistaken for a new product authorization or evidence of patient benefit.
